Introduction, Scope and Object
  1. The General Terms and Conditions of sales intend to provide all the necessary information for placing orders, sales, payment and delivery of services or products made on www.bloom.com.
  2. These conditions define the steps that are necessary to place orders and ensure the follow-up of the orders/services between the two Contracting Parties.
  3. Before browsing and using the website, please read the General Terms and Conditions, the Privacy Policy and Cookie Policy carefully. If you have any questions regarding the use of this website, please contact Bloom via email geral@bloomflores.com.

Access, browsing and orders made through the website www.bloom.com entails the acceptance of the General Terms and Conditions below.

Flores de Joaquim Santos reserves the right to change these General Terms and Conditions without prior notice. Changes are published in the General Terms and Conditions area of www.bloom.com.

Browsing and using www.bloom.com does not create any kind of business or professional relationship between the user and Bloom – Flores and events.

 

Code of Conduct Policy

Bloom should ensure equal treatment, i.e. unjustified non-discrimination of all users, as well as maintain high levels of technical competence by providing quality service with due efficiency, diligence and neutrality.

In the relationship with its users, Bloom's collaborators should maintain adequate standards of correctness, kindness and courtesy.

The creation, dissemination or storage of content, links or codes with harmful properties or that violate the general principles of law and public order is prohibited. Users must ensure that all personal data is accurate.

Users must ensure that access data is confidential in order to prevent abusive use by third parties. Users are solely responsible for ensuring proper backup, protection and security when accessing the website.

By using our website and/or placing orders through it, users agree to:

  • Browse the website in order to get acquainted with Bloom’s products, services or place real orders;
  • Not create false identities or place false or fraudulent orders;
  • Provide accurate contact details (e-mail address, mailing address, telephone number, etc.) for the delivery of floral arrangements and for the contracted services. By providing the contact information, users consent to being contacted and/or consent that the recipient of the delivery or service is to be contacted.

Bloom will not proceed with the order in cases of non-compliance with these conditions, misuse of the website or if the user does not provide all the necessary information. If any question should arise, Bloom will contact the user. If there is any suspicion of unlawful use, Bloom reserves the right to block or delete the account and void the order.

When browsing and placing orders through this site, users declare that they are over 18 years old and have the legal capacity to enter into contracts.

 

Products

All images, data and specifications present on this website intend to be as close as possible to reality but are presented for illustrative purposes only. Bouquets and floral arrangements in general can change according to the season and stock but will always respect the value, shape and colours. If you have any questions, please contact Bloom for clarification.

If the information present does not correspond to the characteristics of the product, the user or Bloom may cancel the sales and purchase contract under the law in force.

Bloom reserves the right to change prices, specifications, characteristics, images and commercial conditions and services without prior notice.

Bloom makes every effort to present information free of typographical errors. When identified, Bloom will correct any inaccuracy. Prices and the information presented are valid unless there are inaccuracies in spelling, website content or available stock.

 

Product availability

The products and floral arrangements featured on this website are subject to availability of flowers, plants or other ornaments, at the time the order is made. Users may choose to replace it with a similar product, if preferred. If replaced, the invoiced price will be that of the replacement product.

 

Order
  1. Users place their order by completing the purchase process displayed on the website www.bloom.com by adding the product(s) or service(s) to the shopping cart:
  2. To place an order the user must:
  3. A) Register on the website bloom.com, providing the requested information for that purpose.
  4. b) Login by inserting the email-password combination chosen in the act of Registration. If you are not registered, you can access your account or register during the online ordering process.
  5. c) Complete the information and choose the options that are made available during the order completion process (delivery and billing address, shipping method, payment method, as well as the tax identification number and the name you want for tax purposes on the invoice). The user will have to select the delivery address (existing or create a new one) and select the preferred delivery date and time. After completing the order, the user will receive an email notification with the order details and payment details. If the data is incorrect or incomplete, the user can immediately request a change or cancellation of the order placed.
  6. The final confirmation of the order by the user is equivalent to the full and complete acceptance of the prices and description of the products/services available for sale as well as these General Terms and Conditions and Privacy Policy that apply to the Contract thus concluded.
  7. Bloom will honour orders received online within the limits of available stocks. When out of stock of the product/service to Bloom – Flores e Eventos will inform the user as soon as possible.
  8. The information in the invoice are the sole responsibility of the user. The invoice after it is issued cannot be reissued with changes.
  9. Orders are valid for fifteen days, unless the order is registered under a promotional campaign that sets a different deadline. It is not possible to guarantee the provision of the service, the prices, discounts, promotions and offers beyond this deadline.

The order with the products selected by the user on the website will be validated after payment confirmation. The user will need to pay the total amount which corresponds to the total price of the order, VAT included. After payment confirmation, Bloom will begin preparing the order placed. However, Bloom will not be held accountable if it fails to comply with the order in case of out of stock, or for any other reason. In this case, Bloom will contact the user who can withdraw the order or replace the product. By withdrawing an order when payment has been confirmed, the user will be entitled to the refund of the amount paid.

If payment confirmation of the order placed is not received within the deadline, the order will not be validated nor processed. Any payment received after the deadline will be refunded or used in a new order.

 

Online Account creation/Registration

Users register at www.bloom.com. To do so, users must enter information such as: name, tax identification number (NIF), telephone number, billing address (full), delivery address, among other mandatory Optional fields.

After registering, when users log in and access their personal accounts, they have access to:

  • The data and personal information entered;
  • Billing address and delivery address;
  • Order history.

 

Payment Methods
  1. Bloom offers the following payment methods:
  2. A) Credit card (Visa, Mastercard) via RedUnicre: This payment method, as well as payment by ATM (Multibanco reference number), guarantees faster order processing.
  3. b) Multibanco via Easypay - Instituição de Pagamento Lda: Allows the payment of the amount indicated in the order to be made in any ATM or through the user’s online banking system. Information with entity, order reference and amount will be provided. Once the payment is completed, Bloom will send an email confirming the payment and order, to increase the effectiveness of payments (their receipts) and shorten deadlines.
  4. When payment is made by credit card, the user's card will be debited immediately after the products are shipped. If ordered products are sold out, their value will be credited to the user's card after the order has been closed.
  5. All prices shown on this website include VAT at the legal rate in force in Portugal.

 

Delivery, availability and consumption
  1. Orders are delivered on the date selected by the user when placing the order. Deliveries in the Porto area are made by Bloom. In other locations deliveries are made by one of Bloom’s partners.
  2. Shipping is free for orders equal to or greater than €35, with deliveries from Monday to Saturday in the Porto area. Prices will be provided on request for deliveries on Sundays and in other locations.
  3. The service is made available after payment confirmation.

 

Shipping and delivery of orders in Portugal

Shipping is free for orders equal to or greater than €35, with deliveries from Monday to Saturday in the Porto area. In Lisbon delivery starts at €10 (final price is provided on request based on the delivery address). For deliveries in the Porto area Bloom makes known that if no one is found to accept the delivery, an additional fee of €10 will be charged for each delivery attempt. The user can go to the Shop to collect the order.

Delivery times in Porto: Weekdays between 10h00 and 18h30; Saturdays: between 10h00 and 13h00.

 

International deliveries

Bloom ships orders worldwide. This service must be carried out 24 to 48 hours in advance and is not available on Sunday and local holidays. Delivery fee varies by country of delivery.

The company that makes the deliveries in other countries is external to Bloom, but if you have any suggestions or complaints, users can address them to Flores de Joaquim Santos.

Prices
  1. Prices are in Euro, with taxes and fees includes (VAT in force in mainland Portugal at the time of payment).
  2. In the event of an increase in the prices of any product/service, the user will be informed immediately and may choose to receive the order (and pay amount due) or cancel it.
  3. Prices shown are valid for purchases made in mainland Portugal, except for computer errors or typographical errors. Delivery is free in Porto, Portugal.
  4. Product prices are subject to change without prior notice.

 

Cancellation Policy, Right of withdrawal and Returns
  1. The cancellation or return process is dealt with on a case-by-case basis by Bloom. The request must be in writing to the email geral@bloomflores.com, within 14 days after placing the order and up to 24 hours before the expected time of delivery. Cancellation, withdrawal or the return of the amount paid and/or merchandise will defined by Bloom and the user will receive an answer by the same means of communication.

Users may cancel an order at any time after logging in to their account. If payment has been made but you wish to cancel the order, send an email to geral@bloomflores.com notifying Bloom of the intention to cancel the order, indicating the order number and requesting the refund of the amount paid.

  1. The refund for the amount should be made using the same payment method. If it is not possible, the user must provide proof of payment and of ownership of the account or card to be used for a bank transfer.
  2. Cancellation of orders, return of products, issuance of a credit notes or refunds shall be made on a date to be agreed between the user and Bloom. Bloom will reimburse the user within a maximum of 14 (fourteen) days.
  3. Most of the products sold on this website are perishable, personalized and highly sensitive, so the user can only cancel the order without additional charges up to 24 hours prior to the expected time of delivery. A flower, tree or plant is a product with a short life cycle and thus, it is not possible to return or exchange, since the product will not in its perfect original state.

For perennial products, the user has a period of 14 (fourteen) consecutive days after the date of conclusion of the contract or receipt of the product to freely resolve the purchase agreement with Bloom, provided that the products have not been used and are in their perfect original condition, in the original packaging, with all accessories and documents relating to the order.

Returned products must be in the condition of sale, that is, in the same state as when they arrived at the user's hands, without anomalies or damages.

  1. If the total amount that results from the exchange of products in an order is less than or greater than the initial value of the product, adjustment conditions will be indicated by Bloom.
  2. According to Decree-Law No. 24/2014 of 14 February, there are exceptions to the right of free resolution (article 17), which we quote (our translation):

"-unless otherwise agreed by the parties, the consumer may not freely settle the contracts of:"

(...)

"(c) supply of goods made to consumer specifications or manifestly customized;

(d) Supply of goods which, by nature, cannot be returned or are liable to deteriorate or be expired; "

(...)

"(i) its enforcement shall begin with prior expressed consent of the consumer; and

(ii) The consumer acknowledges that his consent implies the loss of the right of free resolution;"

Bloom’s after-sales assistance may take between 24 to 96 hours (1 to 4 business days). Please use the following contact information:

Opening hours: Monday to Saturday, from 08h30 to 20h00 and Sunday from 9h00 to 13h00.

 

Online Safety

The website www.bloom.com was developed with the utmost care in order to ensure the protection of the data inserted by the user, as well as to prevent unauthorized access to data, abusive use, its dissemination, loss or destruction. Nevertheless, the accuracy and correctness of the information provided may not be guaranteed.

It is, however, the responsibility of the user to ensure that the device with Internet access is adequately protected against harmful programs, worms and computer viruses. We recommend the following safety instructions:

  • Do not use public computers to enter personal data, such as credit card numbers;
  • Ensure data confidentiality;
  • Memorize access data;
  • After accessing personal accounts, always log out;
  • Use an updated antivirus software on devices;
  • Update device's operating system;
  • Update Internet browser;
  • Use a firewall that is enabled to block external access attempts to the computer.

 

Privacy Policy

The processing of personal data complies with the legislation on the protection of the privacy and the processing of personal data. The data is computer processed and will be listed on Bloom’s database(s). The data is intended for user access, the presentation of other products and services, as well as institutional information.

Providing personal data is optional and Bloom guarantees, in accordance with the law, the right to access, change and delete any personal data. This may be in person or by letter or e-mail, directly to the contact provided on the home page.
